1. Who we are

Home Property is an online property marketplace for the Johor Bahru, Malaysia market, operated by Homeproperty Marketing ("we", "us", "the Seller"). When you use this website or purchase credit packages, you are contracting with Homeproperty Marketing.

By accessing or continuing to use Home Property, you agree to these Terms & Conditions. If you do not agree, please do not use the service.

2. The service

Home Property lets property seekers browse and enquire about property listings, and lets registered real estate agents publish property listings using prepaid credits. We are a marketplace and advertising platform only: we are not a party to any sale, purchase or tenancy agreement, and we do not verify the accuracy, availability or legality of listings. Agents are solely responsible for the content they publish.

3. Accounts

• You must provide accurate information when registering, including your name, contact number and, for agents, your REN number, and keep it up to date.
• You must keep your account credentials confidential and are responsible for all activity under your account.
• You must have the authority to act for the agency or organisation you represent, or be of legal age to contract if registering as an individual.

4. Credit packages and listings

• Credits are sold in one-time packages (for example Basic and Pro). Credits are not a subscription and do not renew automatically.
• Publishing one listing costs 1 credit. Each listing remains live for 60 days from publication and then expires automatically.
• Each package carries a maximum number of active listings per agent account. Upgrading to a higher package raises that limit; credits already in your account are kept.
• Credits are linked to your account, are non-transferable, and have no cash value.

5. Payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms). Prices are charged in Singapore dollars (SGD) as shown at checkout.

6. Acceptable use

You must not misuse the service. In particular, you must not:

• use the service for any unlawful purpose, or to commit fraud or send spam;
• publish listings that are false, misleading, or infringe anyone's intellectual property or other rights;
• interfere with the security or operation of the service, including introducing malware, probing or scanning systems, or scraping content at scale;
• reverse engineer, resell or redistribute the service, or circumvent technical limits such as credit or listing caps.

7. Intellectual property

We retain all ownership of the service and its intellectual property, including the software, design, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected package.

You retain ownership of the content you upload (such as listing photos and descriptions). You grant us a limited licence to host, process and display that content solely to operate and promote the service. If you believe content on the site infringes your rights, contact us and we will review and remove it where appropriate; repeated infringement may lead to account termination.

8. Service level and warranties

We do not guarantee that the service will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability to you is capped at the fees you paid to us in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury where the law does not allow it.

10. Suspension and termination

We may suspend or terminate your access if you materially breach these terms, fail to pay amounts due, create a security or fraud risk, or repeatedly or seriously violate our policies. When access ends, your listings are removed from public view; you may contact us within 30 days to request an export of your listing content, after which it may be deleted.

11. General

• These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over disputes.
• You may not assign your account or these terms without our consent; we may assign them in connection with a merger or acquisition.
• We are not responsible for delays or failures caused by events beyond our reasonable control.
• We may update these terms from time to time; continued use of the service after changes take effect constitutes acceptance.
